Dimensioni organizzative e modelli culturali in sanità: stato dell'arte e prospettive evolutive

The paper aims to contribute to the reflection on the reform of the EU role and competences in the field of public health and an analysis of the impact on the reform draft of Title V, Part II of the Constitution. The developments and outcomes of the current health emergency ledus to reflect on the strong and inseparable link between solidarity and the right to health, as well as on the indivisibility of the State,the levels of autonomy of the European Union and the role of the regions in health policy. Awareness of the fundamental role played by local authorities in managing the health crisis and of the importance that solidarity assumedwithin the domestic debate, as well as within the relationship between EU andStates, suggests the adoption of an alternative model inspired by thisprincipleintegrated withthe principle of loyal cooperation and based on the integration of competences at all the institutional levels. Furthermore, enhancedand 'reformed' cooperation,open to the participation of the regions,provides an opportunity to reflect on the desirability of thereassessmentof rolesharing and on the redistribution of competences to develop anew and more effective models of social development,differentiated on the basis onthe fullness and effectiveness of multi-levelhealth protection.

L’articolo intende offrire un contributo alla riflessione sulla riforma del ruolo e delle competenze dell'Unione europea in materia di sanità pubblica e un'analisi dell’impatto sul progetto di riforma del Titolo V, parte II della Costituzione. Gli sviluppi e gli esiti dell'emergenza sanitaria in corso inducono a riflettere sul legame forte ed inscindibile tra solidarietà e diritto alla salute, nonchè sull'indivisibilità dello Stato, sui livelli di autonomia dell'Unione europea e sul ruolo delle Regioni nella politica sanitaria. La consapevolezza del ruolo fondamentale svolto dagli enti locali nella gestione della crisi sanitaria e del peso che la solidarietà ha assunto nel dibattito a livello interno, così come è avvenuto a livello europeo nel rapporto con gli Stati, suggerisce l'adozione di un modello alternativo ispirato al principio di solidarietà e di leale collaborazione e fondato sull'integrazione delle competenze a tutti i livelli istituzionali. La cooperazione rafforzata e «riformata» aperta alla partecipazione delle Regioni offre, altresì, lo spunto per riflettere sull'opportunità di una ricognizione dei ruoli e sulla redistribuzione delle competenze in funzione dell'elabotazione di nuovi e più efficaci modelli di sviluppo sociale differenziati per la pienezza ed effettività della tutela multilivello del diritto alla salute.
