The article aims to reflect on the dysfunctions of school administration and the consequences of persistent disorganization on the effectiveness of the right to inclusion and academic support for students with severe disabilities. The investigation focuses on the obligations of results that underlie the dutiful nature of the administrative power exercised, on the intensity of judicial review, as well as on the role of the GA in identifying a type of liability directly linked to the conduct of the school principal and which marks a turning point in the jurisprudential approach to the matter. By identifying the unlawful aspects of the school principal’s conduct, case law has drawn significant consequences regarding potential financial liability in the event of repeated unlawful conduct, ordering the transmission of the documents to the Prosecutor’s Office of the Court of Auditors
L’articolo intende svolgere alcune riflessioni sulle disfunzioni dell’amministrazione scolastica e sulle conseguenze della persistente disorganizzazione sulla effettività del diritto all’inclusione e al sostegno scolastico degli alunni con disabilità grave. L’indagine si sofferma sugli obblighi di risultato da cui discende la doverosità del potere amministrativo esercitato, sull’intensità del sindacato giurisdizionale, nonché sul ruolo del GA nella individuazione di un tipo di responsabilità collegata direttamente al comportamento del dirigente scolastico e che segna un punto di svolta nell’approccio giurisprudenziale alla materia. Dall’individuazione dei profili di illegittimità riconducibili alla condotta del dirigente scolastico la giurisprudenza fa discendere importanti conseguenze sul piano della possibile responsabilità erariale in caso di condotte illegittime reiterate, disponendo la trasmissione degli atti alla Procura della Corte dei Conti.
