The affirmation of the principle of autonomy and the resulting responsibility of managers postulates the partecipation to the determination of the function of the administrative function. At the local level, the law n. 142/90 - as amended by the Bassanini laws - even opting for a clear separation of powers, made it clear that the diversity of functions corresponds to a commonality of goals. Pursuant to the art. 110 TUEL the Public Authority can resort to forms of external collaboration, providing for the assignation of posts of the executives with fixed-term contracts, in this case the official “acting as the manager” is competent to adopt the related acts assuming its responsibilities within and out of the Body.
