The note examines the balance between, on the one hand, the highly personal right to be forgotten, in the dual sense of protecting the “dynamic identity” of the individual and digital privacy, and, on the other hand, the right to report news as an expression of the right enshrined in Article 21 of the Constitution, highlighting how the ruling analyzed contributes to a clearer delineation of the boundaries between the various conflicting interests. In particular, the Court of Cassation highlights why, regardless the data subject’s notoriety, even if only at the local level, the right to be forgotten may prevail over the public interest in information, the decisive importance of the obsolescence of the news, the failure to update it, as well as the disproportionate impact that its continued dissemination would be likely to have on the personal identity of the person concerned.
