This article analyses the evolution of the special curator (curatore speciale) for minors in light of the civil procedure reform (Legislative Decree No. 149/2022, the so-called Cartabia Reform) and of the amendments introduced by Law No. 70/2024 on the prevention of bullying and cyberbullying. Starting from the ther apeutic challenges raised by eating disorders (EDs), the article shows how Italian law provides adults with flexible, non-substitutive support instruments – chiefly the amministrazione di sostegno (support administration) – while a gap persists in the living law’s protection of minors. Through a systematic reinterpretation of the relevant provisions of the Civil Code and the Code of Civil Procedure, and by building on the recent rules on the special curator’s substantive powers of representation, the author proposes a reconfiguration of the institution modelled on the support administration, for contexts in which the interests of the minor and of the parents converge. The article offers interpretative and operational in sights towards a legal framework better suited to the psychological fragilities of minors, moving beyond the rigidity of the adversarial paradigm and enhancing the judge’s role in tailoring the curator’s mandate to the individual case.
Il presente contributo analizza l’evoluzione della figura del curatore speciale del minore alla luce della riforma del processo civile (d.lg. n. 149 del 2022, c.d. riforma Cartabia) e delle modifiche introdotte dalla legge n. 70 del 2024 in tema di prevenzione del bullismo e cyberbullismo. Prendendo le mosse dalle difficoltà terapeutiche che emergono nei casi di Disturbi del Comportamento Alimentare (DCA), il lavoro evidenzia come il sistema normativo italiano garantisca al mag giorenne strumenti flessibili di supporto come l’amministrazione di sostegno, mentre persista un vuoto di tutela nel diritto vivente minorile. Attraverso una rilettura sistematica degli articoli del codice civile e di procedura civile e valoriz zando le disposizioni recenti sulla rappresentanza sostanziale del curatore spe ciale, si propone una riconfigurazione dell’istituto che lo assimili all’AdS, in con testi di convergenza d’interesse tra minore e genitori. Il contributo offre spunti interpretativi e propositivi per un impianto giuridico piú adatto ad affrontare le fragilità psichiche dei minori, superando la rigidità del paradigma conflittuale e potenziando il ruolo del giudice nell’adattamento personalizzato del mandato.
