On 21 May 2018, Legislative Decree no. 62 was approved, which amended the tourism code according to the indications of the European directive. The contribution, after proposing an organic reconstruction of the rules already present in the civil code suitable to regulate the general category of partial non-performance, both quantitative and qualitative, highlights the ratio of the amendment aimed at ensuring the traveler “that and just that” even in the presence of a slight discrepancy. No different are the purposes of the legislator on the subject of supervening events not attributable to the professional, a topic where the bearing of the relative risk assumes a more severe conformation compared to the discipline of the code, since on the seller or on the travel agent not only weighs the bearing of the impediment, but also weigh the costs necessary to prepare a substitute performance, to remedy, also in this case, the frustration of the creditor’s interest. The contribution also highlights an error, not present in the text of the amendment, of the community legislator who had excluded the possibility of terminating the contract in case of irremediable lack of conformity.
Il 21 maggio 2018 veniva approvato il decreto legislativo n. 62 col quale si provvedeva a novellare il codice del turismo secondo le indicazioni della direttiva europea. Il contributo, dopo aver proposto una ricostruzione organica delle norme già presenti nel codice civile idonee a disciplinare la categoria generale dell’inadempimento parziale sia quantitativo sia qualitativo, pone in evidenza la ratio della novella rivolta ad assicurare al viaggiatore “quello e proprio quello” già in presenza di una lieve difformità. Non diverse le finalità del legislatore in tema di sopravvenienze non imputabili al professionista, tema ove la sopportazione del relativo rischio assume una più severa conformazione rispetto alla disciplina del codice, giacché sul venditore o sull’agente di viaggio non solo grava la sopportazione dell’impedimento, ma gravano anche i costi necessari ad approntare una prestazione sostitutiva, per porre rimedio, anche in questo caso, alla frustrazione dell’interesse del creditore. Il contributo, inoltre, mette in evidenza un errore, non presente nel testo della novella, del legislatore comunitario il quale aveva escluso la possibilità di risolvere il contratto in caso di difetto di conformità irrimediabile
