Restorative Justice (RJ) continues to capture the attention of philosophers, sociologists and psychologists, as well as lawyers, given the complexity of emotions, behaviours and socio-legal aspects that unfold along its routes. RJ’s transformative practices focus on repairing harm and overcoming trauma for victims, while aiming to recover the offender and re-establish fair, shared and legal social relationships. The text of the law as such is not significant in RJ, which makes RJ’s practices little compatible with the Italian principles of general legislation and meticulous analysis of the case. In this work we want to outline a comparison between the non-European dimension of RJ, of ancient and varied tradition, and the Italian one, with attention especially to the aspects of media dissemination – inhibited in Italy by the current regulations on privacy – and the role of language-cultural mediation in the dialogue between the parties.
