Having premised the analysis of the meaning of memoria in ancient culture, and in particular in the daily existence of the Romans, the study focuses on its centrality in law, looking at the importance and persistence over time of the institution of damnatio memoriae. Having acquired this data, the function held by the idea of memoria in the Novella I of Theodosius II, of the year 438, with which the Theodosian Code was published in the East, is examined: a precise role, aimed at connecting codification (a fact absolutely new) to the previous legal system.
