Relevance of Strategic Infrastructures to Strengthen the EU’s Role on the Global Scenario: The Case of Ports To strengthen its role on the global scenario, the EU leverages on the strategic infrastructures as a useful instrument to put the EU at the centre of the global movements of goods and people and to attract foreign investments. Taking as an example the case of ports, the study reconstructs the difficult course that transformed them from a simple transport infrastructure into a neuralgic node of the Trans- European Networks, key instrument of EU growth, development, cohesion. To consolidate the central role of the port, the EU adopted rules aimed at assuring the opening of the service market and the transparency of the financial resources furnished by States. At the same time, on the international level, the EU pressed, both in multilateral and bilateral negotiations, for the adoption of rules aimed at restraining the acquisition of control over the ports by foreign investors, mainly those which are connected with Governments of their States of origin (Sovereign Wealth Funds and State-Owned Enterprises). To reinforce the protection against more aggressive investors, in particular Chinese ones, the EU adopted Regulation 452/2019 that introduces a Commission-States cooperation mechanism to control the foreign investment deemed as dangerous for projects of common interest. In conclusion, the study underlines that only with the elaboration of common standards with trade partners, it could be possible to effectively protect the EU strategic infrastructures and, at the same time, to strengthen the EU’s role as a global actor.

Per rafforzare il proprio ruolo sullo scenario globale, l’UE ha fatto leva sulle infrastrutture strategiche come utile strumento per porsi al centro della circolazione globale di merci e persone e per attrarre investimenti stranieri. Assumendo ad esempio il caso dei porti, lo studio analizza il difficile percorso che li ha trasformati da mera infrastruttura di trasporto a nodo nevralgico delle Reti Transeuropee, strumenti chiave di crescita, sviluppo e coesione. Per consolidare la rilevanza dei porti, l’UE ha adottato regole finalizzate ad assicurare l’apertura del mercato dei servizi e la trasparenza delle risorse finanziarie fornite dagli Stati. Nel contempo, sul piano internazionale, l’UE ha fatto pressione per l’adozione, sul piano multi e bilaterale, di norme finalizzate ad evitare l’acquisizione di controllo sui porti da parte di investitori stranieri, in particolare quelli connessi con i Governi, come i Fondi sovrani e le imprese pubbliche. Per rafforzare la protezione delle infrastrutture strategiche come quelle portuali contro gli investitori più aggressivi, in particolare quelli cinesi, l’UE ha adottato il Regolamento 452/2019, che ha introdotto un meccanismo di cooperazione tra Commissione e Stati per controllare gli investimenti stranieri pericolosi per i progetti di interesse comune. In conclusione, lo studio sostiene che solo attraverso l’elaborazione di standard comuni con i partner commerciali, è possibile proteggere efficacemente le infrastrutture strategiche e, nel contempo, rafforzare il ruolo dell’UE come attore globale.
