The article deals with the issues related to the availability of the legitimate interest, with particular reference to the eligibility of the transferability to the third part of the subjective legal position regardless of the underlying legal relationship and also to the transferability of the right to damage compensation and to the other forms of judicial protection of the legitimate interest. The analysis focuses in particular on the cases of transfer of legitimate interest connected with the exercise of building capacity of soils. In a rather varied context, the paper emphasizes subjective events related to the transferability of the building rights that may generate several other situations which may interfere with the public power. This is due to the particular and qualified relationship established with the property that allows to recognize a personal interest in the conservation of the property in the proceedings, and, possibly, the opportunity to make a judicial intervention in support of the owner within the additional trial started by him.

Il lavoro affronta le problematiche connesse alla disponibilità dell’interesse legittimo, con particolare riferimento all’ammissibilità o meno della trasferibilità a terzi della situazione giuridica soggettiva indipendentemente dal rapporto sottostante, nonché alla circolazione del diritto al risarcimento del danno e delle altre forme di tutela dell’interesse legittimo pretensivo. L’analisi si appunta, in particolare, sulle vicende traslative dell’interesse legittimo connesse con l’esercizio della capacità edificatoria dei suoli. In un panorama quanto mai variegato, il lavoro si sofferma sulle vicende soggettive legate alla trasmissibilità dei diritti edificatori che possono generare una serie di altre situazioni che interferiscono con il pubblico potere. Ciò in virtù della particolare e qualificata relazione che si instaura con il bene che consente di riconoscere un interesse personale alla conservazione dello stesso nel procedimento ed, eventualmente, la possibilità di spiegare un intervento ad adiuvandum nel successivo giudizio intrapreso dal proprietario dell’immobile.
