Defending the indigent people has to be considered fully a public function, that is an exercise of a public service that presupposes and requires, as first, a correct formulation and, subsequently, an appropriate control for the adequacy of the assignment. In the absence of a formal authorization that is not entirely free from assessments of a discretionary nature, who has already earned the title of lawyer (but also practicing lawyers registered that, as such, can accrue seniority required for enrollment of the lawyers) cannot be considered legitimate to exercise legal aid of the State. The Bar Council shall assess the existence of requirements and conditions, while retaining the ability to revoke the act. Due the nature and qualification of legal aid of the State, related disputes are submitted to the jurisdiction of the administrative judge.
