In proceedings concerning the authorization of projects aimed to the implementation of interventions on sites of Community importance, the issue or the completion of the building permit is subject to the verification of the acquisition of environmental impact assessment. The primacy of the environment on freedom of private economic initiative postulates that the need for simplification must not lead to an illegitimate compression of a primary value, as the environment, and a posthumous authorization could not be recognized able to put the intervention right but it has to be considered illegitimate both because it intervened late compared to the normal procedural sequence, and because it is completely unfit to dissolve the serious repercussions of the project on the environment.
